EMERGENCY WATER CONSERVATION REGULATION

The State Water Board finds that Governor Newsom’s March 24, 2023, Executive Order (N-5-23), which reduced emergency drought requirements, does not immediately terminate current State Water Board (Board) water conservation emergency regulations.

The requirement for urban water suppliers to implement demand-reduction actions that correspond to at least Level 2 of their water shortage contingency plans is no longer in effect since June 5, 2023. Local water suppliers may adopt different and/or stricter water conservation measures;

The Emergency Regulation to Prohibit Wasteful Water Uses (like refilling fountains without recirculating pumps, overwatering landscapes, watering grass within 48 hours of rainfall, etc.) is set to expire in December 2023, unless the Board takes further action. The Board may continue to enforce these prohibitions and may consider readopting them. Like the decorative grass watering ban, these prohibitions coincide with the state’s long-term goal of Making Conservation a California Way of Life, regardless of the weather.

WATER CONSERVATION ORDINANCE

Under the water conservation ordinance, all unnecessary and wasteful uses are prohibited. Water conservation measures are an important first step in protecting our water supply. You can find the detailed definition of unnecessary and wasteful water waste here.

WHAT WASTEFUL WATER USES ARE PROHIBITED?

To promote water conservation, the use of potable water is prohibited in this emergency regulation for the following:

1. Applying water to outdoor landscapes resulting in more than incidental runoff

2. Washing vehicles without an automatic shutoff nozzle

3. Washing impervious areas

4. Street cleaning or construction site prep

5. Decorative fountains, lakes, or ponds

6. Irrigating turf within 48 hours of one fourth of an inch (¼”) of rainfall

7. Irrigating turf on public medians
