There are two issues here that need to be dealt with.
My neighbor at 719 J Street, Lathrop, CA. a few years ago put up a Tarp Lean-to carport between their garage and the fence between our two properties. (Their reasoning was that they had purchased a new car and they didn't want the weather to damage the paint.)
Over the years the tightening of the ropes holding the tarp taught between the house and the fence has caused the fence to be pulled to one side and cause issues with the opening of my two gates at the front of my house. One gate is a drive through gate to the back yard and the other is a walk through access gate to the back yard.
I have talked to the Mr. Cunningham about the fence and his fix was to add additional 4x4 posts screwed to existing posts too help support the fence.
Lately Mr. Cunningham has nailed carpet tack strips to the fence to keep animals, (cats), from climbing the fence and getting up on his roof using the tarp carport as access to their roof. I was finding blood on our back patio and couldn't figure out how our cats were cutting their paws. I thought it was from our roses and I have been slowly taking them out. I have since found the carpet tack strips nailed to the fence.
This neighbor has also caught one of our cats in a trap and put it into his truck and taken it down the freeway to Roth Rd and let it go out in the field. (We have never found the cat but we did call Animal Control and they came out and talked to Mr. Cunningham.)
My questions are 1. Is the tarp lean-to carport attached to the fence a viable structure? 2. Is the nailing of carpet tack strips to keep animals from walking the fence line allowable, and can I take action for my cats paws getting punctured or cut on those strips?
